ABOUT THE COURT ORDERS AND THE COVID-19 PANDEMIC:


There is not a simple rule for court and the pandemic. There is no simple explanation and no simple procedure, as to how to deal with traffic courts and criminal courts during this COVID-19 Pandemic in California. The presiding and supervising judges in the Superior Court of California continue to change court orders, issuing new orders and modifying previous orders. The lesser judges continue to self-interpret the orders, for better or worse. The court clerks are just as confused, if not more so, than the rest of us. Our attorney has appeared in and contacted several courts during this time, and there is much inconsistency and misunderstanding to be found. Our attorney has been better briefed and more aware of the court orders than the individual courtrooms. So, if you want clarity, the courts will not provide it. 


We do not blame the individual courtrooms, at least the ones that try to be helpful, because this has been thrown at them without notice. And, so long as there is flexibility and understanding in the future, we should be so patient with the courts. 


In contrast, the courts must not take advantage of this situation. Government workers should not be taking vacation with pay--tax dollar pay--during the pandemic. They should be diligently contacting attorneys and or defendants to inform them of the continuances on their cases. Many courts are doing their work diligently. However, far too many courts are shirking their responsibilities and failing to give notice of continues and failing to continue cases that are not allowed to be heard. Again, this is not the majority, but for the few taking advantage of this situation, it is unfortunate, and it hurts the public and individual defendants.


In the meantime, as a criminal defense firm, we are working hard to keep up on the developing situation.  


However, you need to know that most court dates are delayed. Some have been delayed with no future court date set, yet. Some have been reset and then reset again. Some have been continued out 90 days, in hopes that this will all be over soon. 


Access to courts is greatly reduced. Do not go to court, because they will not let you in, unless you are an essential part of a case that is having an essential hearing. You need to ask your attorney if this applies to you and your case. But generally, this does not apply to most misdemeanors. 


Court clerk's office and other services are closed or greatly reduced. Other case-related providers and services are closed or reduced. You need to check by phone or online first, to find out what you can access or not. For example, the DMV is by appointment only. There are no walk-ins. Appointments may be far out into the future.

To sum-up, cases are being continued. The courts are not updating all cases timely. However, your attorney can go to court and contact the court on your case to make sure it is being handled properly. Because of the pandemic, courts and court services are closed or reduced.


Your choices are to either let your attorney deal with all the confusion and inconsistencies, or you could read all the court orders, stay up to date on new court orders, sue the courts for violations of your constitutional rights and access to justice... That will put you in a pattern like the above traffic sign.
